Terms of Service

These Terms are the agreement between you and GoochieGoo LLC, a California limited liability company ("GoochieGoo", "we", "us"), for the use of the GoochieGoo app and website. They are written to be read, not to be survived. Please do read section 5, which is about what GoochieGoo is not, section 10, which is about your subscription, and sections 14 and 15, which limit what we are responsible for.

1. Accepting These Terms

By creating a GoochieGoo account, or by using the app, you agree to these Terms, the Privacy Policy and the Medical Disclaimer. If you do not agree, please do not use GoochieGoo.

If we change these Terms in a way that matters, we will tell you in the app before the change takes effect, and update the date at the top. Continuing to use GoochieGoo after that means you accept the new version.

2. Who May Use GoochieGoo

You must be at least 18 years old, and you must be the parent or legal guardian of any baby whose profile you create, or a caregiver that parent or guardian has invited. GoochieGoo is for adults; it is not directed to children and children may not use it.

By creating a baby's profile you confirm that you have the authority to provide that child's information and to make decisions about it.

3. Your Account

The account is yours to keep secure. Use a password you do not use elsewhere, and tell us at hello@goochiegoo.app if you think someone else has access to it. You can also sign in with Apple or Google, in which case their sign-in rules apply too.

You are responsible for what happens under your account, including what the people you invite into your Village do with the access you give them.

4. What GoochieGoo Does

GoochieGoo lets you log feeds, sleep, diapers, growth and milestones, keep your baby's profile and photos, see a daily plan and weekly patterns, keep a private check-in journal, share the record with the caregivers you choose, ask Goochie questions, and receive everyday guidance and reminders.

We may add, change or remove features. If we remove something you rely on, we will give you notice where we reasonably can.

5. GoochieGoo Is Not Medical Advice

This is the most important section in this document.

GoochieGoo and Goochie give general, everyday information to support you as you care for your baby. Nothing in the app diagnoses a condition, treats an illness, or tells you what medication to give. GoochieGoo is not a medical device, and it is not a substitute for the judgment of your pediatrician, who knows your baby's history and can examine them directly.

Guidance in the app, including Ask Goochie's answers, is general and based on your baby's age and the records you enter. Ask Goochie uses an AI system, and its answers can be wrong. Contact your pediatrician about health questions, even if an app response sounds reassuring. The full Medical Disclaimer is part of these Terms.

6. Your Content Stays Yours

The photos, logs, notes, journal entries, questions and captions you add are yours. We do not claim ownership of any of it.

You give us a limited licence to store, copy, process and display that content, solely so that we can operate GoochieGoo for you and for the caregivers you have shared it with. That licence exists only to run the service, it is not transferable to anyone else except the service providers named in the Privacy Policy, and it ends when you delete the content or your account.

You confirm that you have the right to upload what you upload, including any photograph containing another person.

7. Using GoochieGoo Fairly

Please do not:

• Use GoochieGoo for a child whose parent or guardian you are not, unless their parent or guardian invited you.
• Upload anything unlawful, or any image of a child you do not have the right to upload.
• Try to access another family's data, probe the service for weaknesses, or interfere with how it works.
• Try to make Ask Goochie produce harmful content, or use it for anything other than questions about caring for your baby and yourself.
• Scrape, resell or redistribute the app, or use it to build a competing product.
• Use automated systems to create accounts or generate load.

We can suspend or close an account that does any of these, or that puts other families at risk. Where the situation allows it, we will tell you first.

8. Your Village

You can invite other caregivers into your Village with a one-time invite code. You choose what each person can see and do, and you can change that or remove them at any time, which ends their access immediately.

Caregivers you invite join for free. They sign in with their own GoochieGoo login (Google, Apple or email) and enter your invite code; they do not need a subscription of their own (section 10.7).

You are responsible for who you invite. We cannot undo what a person you invited has already seen. Your private check-in journal is never shared with your Village.

9. Notifications

Reminders and nudges are sent only if you turn them on, and you can turn them off in the app or in your device settings. They are a convenience, not a guarantee: a notification can be delayed or lost by your device, your network, or Apple's and Google's delivery systems. Do not rely on GoochieGoo as the only reminder for anything that matters medically.

10. Subscription, Free Trial and Price

GoochieGoo is a paid app. Using it requires an active GoochieGoo All Access subscription, or a free trial of one. There is one plan, and it includes every feature. Caregivers you invite into your Village are covered by your subscription (section 10.7).

10.1 Free trial

New subscribers get a 7-day free trial. You are not charged during the trial. Unless you cancel at least 24 hours before the trial ends, your subscription starts automatically when the trial ends and you are charged the monthly price shown when you started the trial. A free trial is available once per Apple ID or Google account, as the store decides.

10.2 Price

The Founding Family price is $19.99 per month, offered to the first 1,000 subscribers. After that, the price is $29.99 per month. Prices are in US dollars and may include or exclude tax depending on where you live; the store shows the final price before you confirm.

If you subscribe at the Founding Family price, your subscription keeps renewing at that price for as long as it stays active without a break. If you cancel and later subscribe again, the price offered at that time applies.

10.3 Automatic renewal

Your subscription renews automatically every month, and the store charges your account within 24 hours before the end of each period, until you cancel. Payment is taken by Apple or Google through the account you used to subscribe, not by us. We never see your card details.

10.4 Cancelling

You can cancel any time. On iPhone, open Settings, tap your name, then Subscriptions. On Android, open the Google Play Store, tap your profile, then Payments and subscriptions, then Subscriptions. You can also reach these from More, then Subscription, in the app.

Cancelling stops the next renewal. You keep access until the end of the period you have already paid for. Deleting the app, or deleting your GoochieGoo account, does not cancel your subscription; cancel it in the store as well.

10.5 Refunds

Payments are made to Apple or Google, and refunds are handled by them under their own policies. We do not give refunds or credits for partial months, unused time or a cancelled trial, except where the store or the law requires it. To ask for a refund, go to reportaproblem.apple.com for an App Store purchase, or to Google Play's refund page for a Google Play purchase.

10.6 Price changes

We may change the price of a subscription. We will tell you before a change applies to you, and Apple or Google will also notify you and, where their rules or the law require it, ask for your agreement first. If you do not agree, you can cancel before the new price takes effect.

10.7 Your Village is covered by your subscription

A subscription covers the account that bought it and the caregivers that account invites into its Village. Invited caregivers use their own free GoochieGoo login and do not need a subscription or trial of their own. Their access lasts while your subscription or free trial is active, including any grace period Apple or Google gives; if it ends, their access to your family's records ends too. Family Sharing does not apply to GoochieGoo.

10.8 Promotional access

We sometimes give free access to testers or partners. Promotional access ends on the date we tell you, or when we end the programme, and it never turns into a paid subscription unless you start one yourself.

11. The App Stores

You get GoochieGoo through Apple's App Store or Google Play, and their terms apply alongside these. If you downloaded GoochieGoo from the App Store, Apple's standard Licensed Application End User Licence Agreement also applies (apple.com/legal/internet-services/itunes/dev/stdeula), and where it conflicts with these Terms on a point Apple requires, Apple's agreement wins.

For the App Store specifically: this agreement is between you and GoochieGoo LLC only, not with Apple, and Apple is not responsible for GoochieGoo or its content. Apple has no obligation to provide support for the app. If the app fails to conform to any warranty, you may tell Apple and Apple will refund the purchase price, if any; beyond that, Apple has no other warranty obligation. GoochieGoo LLC is responsible for any product liability claim, any claim that the app infringes intellectual property, and any claim under consumer protection law. You confirm you are not in a country subject to a US government embargo and not on any US list of prohibited parties. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

12. Ending Your Account

You can delete your account at any time from More, then Account, then Delete Account. Deletion is permanent and removes your family's records as described in the Privacy Policy. Remember to cancel your subscription in the store too (section 10.4).

We may suspend or end your access if you break these Terms, if we are required to by law, or if we stop offering GoochieGoo. If we discontinue the service, we will give you reasonable notice and a way to export your records first.

13. Availability

GoochieGoo is offered in the United States at launch. We may make it available in other countries later.

14. No Warranties

GoochieGoo is provided as it is and as it is available. To the fullest extent the law allows, we disclaim all implied warranties, including merchantability, fitness for a particular purpose and non-infringement.

We do not promise that the app will be uninterrupted, error-free, or that its guidance, plans or Ask Goochie's answers will be accurate or suit your particular baby. Some places do not allow these exclusions, in which case they do not apply to you.

15. Limits on Our Liability

To the fullest extent the law allows, GoochieGoo LLC is not liable for indirect, incidental, special, consequential or punitive damages, or for lost data or lost profits, arising out of your use of GoochieGoo.

Our total liability for any claim relating to GoochieGoo is limited to the greater of the amount you paid for GoochieGoo in the twelve months before the claim, or one hundred US dollars.

Nothing in these Terms limits liability that cannot be limited by law, including liability for death or personal injury caused by negligence, or for fraud.

16. Indemnity

You agree to cover our reasonable costs if a claim is brought against us because of your use of GoochieGoo in breach of these Terms, or because of content you uploaded that you did not have the right to upload.

17. Governing Law

These Terms are governed by the laws of California, without regard to its conflict-of-laws rules. Any dispute will be brought in the state or federal courts located in California, and we each consent to those courts.

If you are a consumer in a place whose law gives you the right to bring a claim locally, this section does not take that right away.

18. Resolving a Concern

If something goes wrong, please email hello@goochiegoo.app first and give us 30 days to put it right. Most problems are faster to fix than to litigate, and we would rather fix them.

19. The Rest

If a court finds part of these Terms unenforceable, the rest stays in force. If we do not enforce something immediately, we have not given up the right to enforce it later. You may not transfer these Terms to anyone else; we may transfer them as part of a merger or sale of the business.

These Terms, together with the Privacy Policy and the Medical Disclaimer, are the whole agreement between us about GoochieGoo.
